Tim Miltenberger specializes in bankruptcy law, creditors' rights, and commercial litigation. In bankruptcy court, Mr. Miltenberger has successfully reorganized manufacturing corporations, wholesale and retail corporations, and real estate holding corporations under Chapter 11 of the United States Bankruptcy Code. He has successfully litigated fraudulent conveyance actions, preference actions, and turn-over actions. Mr. Miltenberger represents both sellers and purchasers of real and personal property. Mr. Miltenberger also represents consumer debtors.
In civil litigation, Mr. Miltenberger has successfully tried fraudulent conveyance cases in both federal and state court. He has also successfully tried actions to enforce commercial leases, mortgage foreclosure actions, replevin actions, and constructive trust claims. Mr. Miltenberger has successfully defended appeals to the Appellate Court of the State of Connecticut, the United States Court of Appeals for the Second Circuit, and the United States Court of Appeals for the Ninth Circuit.
